OpenAI's Fight For Copyright Immunity In India: 28 Jan 2025. OpenAI Global, LLC has claimed that it cannot be sued for copyright infringement in India; the argument was presented at the Delhi High Court. The ongoing litigation — brought by ANI Media Pvt. Ltd. (ANI) argues that OpenAI trained its AI models using copyrighted content without authorization. The case has been taken up by the Federation of Indian Publishers (FIP) and the Digital News Publishers Association (DNPA), who have stepped in to back ANI’s case.
OpenAI’s lawyer, senior advocate Amit Sibal, argued that its terms of service make it clear that any disputes should be settled according to California law through arbitration or the courts in California. OpenAI argues that this clause renders the lawsuit in India invalid, and questions the Delhi High Court’s jurisdiction over the matter.
Justice Amit Bansal, who is hearing the matter, has chosen to decide on the jurisdictional issue as well as the larger questions of AI-generated content and intellectual property rights. The court has also appointed two legal experts Professor Arul George Scaria of the National Law School of India University and advocate Adarsh Ramanujan as amici curiae (friends of the court) to help navigate the complexities of the case.
ANI’s allegations are backed by two powerful industry groups, the FIP and the DNPA, which represent publishers and media organizations. They say OpenAI’s use of publicly available content amounts to copyright infringement and they raise broader questions about fair use, intellectual property rights, and regulations surrounding AI research.
OpenAI has pushed back on FIP’s involvement by maintaining that its AI models do not rely on paywalled content like books and journals. The company’s legal team also questioned how FIP’s intervention was relevant to the ongoing case.
Such a ruling alongside similar cases has the potential to set a precedent for AI development and content regulation in India. If the Delhi HC decides it has jurisdiction, it could lead to a stricter scrutiny of how AI-generated content is produced and how it syncs and complies with the copyright laws. However, if OpenAI wins the argument for jurisdiction in California, it could set the direction for how legal disputes involving tech companies across borders might be handled going forward.
The court confronted OpenAI with summons associating the intercessions from DNPA and FIP, with a fourteen-day cutoff time for reaction. The choice regardless of whether these mediations will be acknowledged in the case stays hanging.
The ongoing development of AI technology continues to set battles like these in stark relief against the forces of international law, its enforcement of copyright, and its jurisdictional clash over cross-border disputes. If OpenAI wins with California jurisdiction, global regulators and the global intellectual property field will enter a new epoch. Should it lose and face a trial in India, the same will hold.
